1. Introduction and Acceptance
These Terms of Service ("Terms") govern your participation in any driving experiences, track day events, and related services provided by Race Competitions Ltd ("Race Competitions," "we," "us," or "our"), which also trades as Merrills Motorsport. By booking, purchasing, or participating in a Race Competitions event or service, you agree to these Terms as a binding agreement. Please read them carefully. If you do not agree with any part of these Terms, you should not make a booking or purchase with us.
2. Scope of Application
These Terms apply to all standard Race Competitions events and services (including individual driving experiences and gift voucher purchases) offered to the general public. Private Circuit Hire arrangements and bespoke Corporate Events are excluded from these standard Terms of Service; such private or corporate bookings are governed by separate custom contracts agreed in writing with Race Competitions. If you are booking a Private Circuit Hire or a tailored Corporate Event, refer to your specific contract for applicable terms, as those will override any conflicting terms here.
3. Bookings, Payments, and Deposits
Booking Confirmation: A booking is confirmed once the required payment (or deposit, if applicable) has been received and Race Competitions issues a confirmation. All prices are in GBP and are subject to VAT unless stated otherwise.
Cancellations and Rescheduling
When you book an event with us, we incur immediate and non-recoverable costs to secure your place. For this reason, we apply the following cancellation and rescheduling policy:
Deposits Are Strictly Non-Refundable
Any deposit you pay to secure a booking is non-refundable under all circumstances - this applies regardless of how far in advance you cancel or seek to reschedule. This reflects the upfront costs we incur when confirming your place.Cancellation Policy
If you cancel your booking more than 30 days before your scheduled event date, you will forfeit your deposit but may be eligible for a refund of any amount you have paid over and above the deposit. If you cancel within 30 days of the event date, no refund will be issued under any circumstances.No Rescheduling – Treated as Cancellation
We do not offer rescheduling. Any request to change your event date is treated as a cancellation of your original booking and is subject to the same terms outlined above. This means:You will forfeit your original deposit
To book a new date, you will be required to pay a new deposit
No credit or transfer of your existing deposit is offered
We understand plans can change, but once a booking is made, we are unable to recover the costs committed to your place—including track hire, vehicle preparation, staff allocation, and insurance.
No-Show and Late Arrivals:
If you fail to attend your booked event, or arrive too late to participate, your booking will be treated as a cancellation with no entitlement to refund. This applies regardless of the reason for your absence, including illness, travel disruption, or personal circumstances.
By the time of your event, we will already have incurred non-recoverable costs associated with your place—such as track hire, vehicle preparation, staffing, and insurance—which means we cannot absorb the loss or reallocate your slot at short notice.
We cannot offer refunds or rescheduling for no-shows or late arrivals, and a new booking (with a new deposit) will be required if you wish to attend on a future date.
To avoid missing your session, we strongly advise arriving at the event location no later than the check-in time provided in your booking confirmation. Late arrival may result in your session being shortened or forfeited entirely, with no refund or credit issued.
By booking with us, you accept this policy in full.
4. Gift Vouchers
Race Competitions offers vouchers for driving experiences which can be redeemed by the holder for a future event booking:
Validity: Vouchers are valid for the period stated at purchase (if not stated, default validity is 365 days from purchase date). They must be redeemed (used to book an event) before the expiry date.
Refund Policy for Vouchers: A voucher purchase is refundable within 30 days of the purchase date, provided the voucher has not been redeemed or used to book an event. After 30 days from the purchase date, or once the voucher has been redeemed (whichever occurs first), the voucher becomes non-refundable. This means if more than 30 days have passed since purchase, or if the voucher code has been applied to an event booking, you are not eligible for a refund on that voucher.
Transferability: Vouchers are generally transferable to another individual, provided the new recipient meets all standard eligibility requirements for participation in our experiences. This includes, but is not limited to, minimum age, driving licence type, and medical fitness. The responsibility for ensuring eligibility rests entirely with the original purchaser or transferor.
Unauthorised resale or commercial use of Race Competitions Ltd vouchers - such as selling, auctioning, or distributing vouchers without our prior written consent - is strictly prohibited. If we determine that a voucher has been resold or distributed without authorisation, we reserve the right to:
Cancel the voucher without refund; and/or
Require the original purchaser to pay the full retail price of each unauthorised voucher issued.
We may also refuse entry to any individual presenting a voucher obtained through unauthorised channels, even if otherwise eligible. No refund or credit will be issued in such cases.
By transferring a voucher, or by accepting a transferred voucher, both parties agree to be bound by these terms and acknowledge that the Company reserves the right to enforce them at its sole discretion.
Extension: If you are unable to use a voucher before it expires, contact us in advance of the expiry date. Extensions may be granted at Race Competitions’ discretion (an extension fee may apply). Once a voucher has expired, it holds no value and cannot be redeemed, transferred or refunded.
5. Optional Upgrades and Additional Services
We offer various optional add-ons to enhance your experience, such as photography packages, video footage, and passenger ride experiences. These optional upgrades are typically purchased either when booking your event or on the event day:
Optional Upgrade Purchases: All optional add-on services (for example, in-car video recording, professional photographs, extra passenger ride-along sessions, etc.) must be paid in full at the time of adding them to your booking.
Refund Policy for Upgrades: Optional upgrades are refundable within 30 days of purchase only if the service has not yet been delivered or fulfilled. If 30 days have passed since you purchased the upgrade, or if the upgrade service has already been provided (whichever comes first), then the cost of that upgrade is non-refundable. For example, if you purchase a photo or video package, once the media files have been produced/delivered to you (which may be on or shortly after your event date), no refund will be given on that package; similarly, a passenger ride add-on is not refundable after the ride has taken place or after 30 days from purchase, even if not yet used. This excludes damage waivers, which are not 'upgrades' and are non-refundable.
Undelivered Add-Ons: If an upgrade (such as a passenger ride or media package) cannot be delivered on the event day due to timing or operational constraints, we will either offer to reschedule that specific service or provide a refund for that upgrade at our discretion. This clause applies only to the undelivered upgrade, not to the main event booking.
6. Damage Waiver
We offer an optional Damage Waiver designed to limit your financial liability if you accidentally damage the vehicle you are driving during your session.
What the Waiver Covers:
If purchased, and subject to its full terms and conditions, the Damage Waiver caps your liability for accidental damage to the vehicle to the excess amount stated in the waiver agreement. It does not eliminate liability entirely, and it does not cover all scenarios - exclusions apply (e.g. reckless or intentional behaviour, incidents not occurring on the track, and certain flags or pit lane conditions). Full terms will be provided in the waiver document you sign on, or in advance of the event day.
Optional but Strongly Recommended:
The Damage Waiver is optional unless stated otherwise for a specific event. However, if you choose not to purchase it, you accept unlimited financial responsibility for any damage caused, including repair costs, downtime, transport, refunds to other customers, and any consequential business losses.

Non-Refundable:
Once purchased, the Damage Waiver is non-refundable under all circumstances - including if you cancel, do not attend, or do not drive.
7. Participant Eligibility and Conduct
To ensure safety and compliance, all participants must meet the following requirements:
Driving Licence:
You must hold a valid manual driving licence appropriate for the vehicle and event (e.g. a full UK licence or accepted international equivalent). You must bring the original physical licence on the day. If you fail to present a valid licence, you will not be allowed to drive and this will be treated as a no-show—no refund will be given.Age, Health and Fitness:
You are responsible for ensuring you meet any stated age, height, weight, or medical requirements. If you have any health conditions or disabilities that could affect your participation, you must inform us in advance. We will accommodate where we can, but may refuse participation if safety is at risk. You must bring any required medical equipment (e.g. inhalers, insulin, etc).Briefing and Waivers:
You must attend the full safety briefing and sign all required waivers (including the Participation Agreement and, if applicable, the Damage Waiver) before driving. If you refuse to do so, you will not be allowed to participate and no refund will be issued.Clothing and Equipment:
We will provide any required safety gear (e.g. helmets). You must wear appropriate clothing - closed-toe shoes and comfortable attire suitable for driving. You must use all safety equipment as instructed.Conduct:
You must follow all instructions from our team and respect all event rules, including pit lane speed limits and flag signals. Dangerous, reckless, or disrespectful behaviour will not be tolerated.Right to Refuse or Remove:
We reserve the right to refuse entry or remove you from the event without refund if:You don’t meet the eligibility criteria or can’t provide required documents
You are suspected to be under the influence of drugs or alcohol
You behave in a disruptive, unsafe, or abusive way
If removed, you will not be entitled to any refund or rescheduling, and we will not cover any additional costs you incur (e.g. travel or accommodation).
8. Event Changes and Cancellations by Race Competitions Ltd
While we make every effort to run events as scheduled, there may be circumstances beyond our control that require us to cancel, postpone, or amend an event.
Minimum Attendance and Adverse Conditions
Some events may require a minimum number of participants to proceed. We also reserve the right to cancel or postpone any event due to severe weather, safety concerns, venue issues, natural disasters, pandemics, or any other circumstances outside our control that make it unsafe or impractical to continue.Notification
If we need to cancel or significantly change the date or location of your event (a “significant change” means a change of venue or a change in the event’s timing by more than 24 hours), we will notify you as soon as possible using the contact details you provided when booking. This notice will include instructions on how to proceed.Cancellation by Race Competitions
If we cancel an event entirely and do not offer an alternative date or location, you will be entitled to a full refund of all fees you have paid, including your deposit and any add-ons purchased for that booking. Alternatively, you may choose to receive a credit or transfer to a future event of equal value, subject to availability and any applicable price differences.Event Rescheduling
If your event is postponed or rescheduled (e.g. due to weather or venue availability), your booking will automatically transfer to the new date. If you cannot attend on the rescheduled date, you must notify us within the timeframe stated in our notice. You may then request either:A refund of any fees paid (including your deposit), or
A credit toward a future event of your choice, subject to availability
If you attend the event on the new date, your original booking terms will continue to apply, including any non-refundable conditions.
Vehicle Availability and Substitutions
While we aim to provide the specific vehicle you have booked, this cannot be guaranteed. If a particular car becomes unavailable on the day (e.g. due to mechanical failure or damage by a prior participant), we will do our best to substitute it with a comparable vehicle.
Driving a different car in such circumstances does not entitle you to a refund, provided the replacement is of similar value and performance.Interruption Before Your Drive (Car Breakdown or Damage)
If your scheduled vehicle becomes unavailable before your session and no suitable alternative can be provided at that time:We will offer you a reschedule of that drive in the same or an equivalent vehicle, on a future date of your choice (subject to availability)
You will receive written confirmation or a voucher for this replacement booking
If the same issue prevents you from driving again on the rescheduled date, we will issue you a full refund for that portion of the experience
No Further Liability
In all such situations - whether due to vehicle unavailability, event cancellation, or rescheduling - our liability is limited to either rescheduling your session or refunding the fees paid for the affected part of your booking.
We are not responsible for any other costs you may incur, including travel, accommodation, missed work, or other consequential losses.
We strongly recommend booking flexible travel and accommodation, and/or purchasing travel insurance to protect against these eventualities.
9. Limitation of Liability
Assumption of Risk
By participating in our high-performance driving experiences, you acknowledge that motorsport carries inherent risks. While we take every reasonable precaution to ensure safety, accidents or incidents may still occur. You accept these risks and confirm you are participating voluntarily, at your own risk.Personal Injury and Property Damage
Race Competitions Ltd is not responsible for any personal injury or property damage that occurs during an event unless it is directly caused by our proven negligence. All participants are required to sign waivers confirming their understanding of these risks and releasing Race Competitions Ltd from liability to the fullest extent permitted by law.Damage to Vehicles
If you damage a vehicle or any equipment during your session and have not purchased the Damage Waiver, you will be liable for all associated costs.
If you have purchased the Damage Waiver, your liability will be limited to the terms of that waiver, including exclusions for reckless or intentional behaviour, off-track incidents, and other non-covered scenarios. Full waiver terms will be provided on the day.Indirect or Consequential Losses
We are not liable for any indirect or consequential loss you may incur, including loss of income, loss of enjoyment, or costs relating to travel or accommodation -even if the event is cancelled or rescheduled. Our liability is limited to rescheduling the event or refunding the relevant booking fee, in accordance with these Terms.Total Liability Cap
Except in cases of death or personal injury caused by our negligence (or other liabilities which cannot be legally limited), our total liability to you will not exceed the amount you paid us for the specific booking in question, including any add-on services.
This cap does not apply to vehicle damage or consequential losses caused by a participant, which are governed by our separate Liability Terms and Damage Waiver Agreement.Third-Party Services
Where your experience includes services provided by third parties (such as venue facilities or catering), those services are subject to the third party’s own terms and conditions. Race Competitions Ltd is not liable for any acts or omissions by those providers. However, we will use reasonable care when selecting reputable partners and will assist you where possible if an issue arises within our control.
10. Miscellaneous
Changes to Terms
Race Competitions Ltd reserves the right to update or modify these Terms of Service at any time. If we make material changes, we will provide notice—for example, by updating the effective date at the top of this document and/or informing customers via our website or email. Changes will apply to future bookings and events unless otherwise required by law. For customers with existing confirmed bookings, any material changes affecting your rights will be communicated directly and will take effect only with your continued participation or by mutual agreement. It is your responsibility to review the Terms periodically.Entire Agreement
These Terms, together with your booking confirmation, our Refund Policy (which is incorporated herein by reference and available on our website), our Damage Waiver and Liability Terms (where applicable), and any other documents or policies referred to herein, constitute the entire agreement between you and Race Competitions Ltd regarding your purchase and participation in our events.
In the event of a direct conflict between these Terms and any policy referenced, these Terms will govern for matters of participation and service provision, while the relevant policy will govern matters specifically within its scope (e.g. refunds, liability, waiver conditions).Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed to the maximum extent permitted by law and shall not affect the validity and enforceability of the remaining provisions.Governing Law and Jurisdiction
These Terms of Service and any disputes or claims arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. You and Race Competitions Ltd agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such disputes.
