Refund Policy
1. Introduction
This Refund Policy outlines the conditions and procedures for obtaining refunds or rescheduling in connection with driving experience events offered by Race Competitions Ltd (trading as Merrills Motorsport (“we,” “us,” or “the Organiser”). By purchasing a voucher or booking an event, you (“participant” or “customer”) acknowledge that you have read, understood, and agree to the terms below.
This Refund Policy forms an integral part of our Terms of Service. It is designed to be clear, final, and unambiguous. It applies only to our public driving experience products and does not cover Private Circuit Hire or Bespoke Corporate Events, which are governed by separate written agreements.
2. General Refund Conditions
Participant Cancellations (Customer-Initiated):
If you choose to cancel your booking, the following applies:
All deposits are strictly non-refundable, regardless of how much notice you give. This is because we incur non-recoverable costs from the moment you book.
If you cancel more than 30 days before your scheduled event, any amount paid above your deposit may be refunded.
If you cancel within 30 days, no refund will be issued under any circumstances.
Rescheduling is treated as a cancellation. If you wish to move to a new date, your original booking will be cancelled and subject to the same refund rules as above. A new booking will need to be made, and a new deposit paid.
Note: These conditions apply only to the core event participation fee. Optional extras and add-ons (such as media packages and damage waivers) have their own refund rules, outlined in Section 5.
Organiser Cancellations (Company-Initiated):
If we cancel or postpone an event for reasons beyond our control (e.g. venue issues, weather, insufficient numbers, or operational risks), we will:
Offer you a reschedule to an equivalent event.
If rescheduling isn’t possible or you are unable to attend the new date, you will be entitled to a full refund of your event fee, including your deposit and any add-ons.
These remedies are the sole form of compensation. We are not responsible for any additional costs you may have incurred (such as travel or accommodation).
3. Vehicle Unavailability Before Scheduled Drive
If your booked vehicle is unavailable before your drive begins (e.g. due to damage or mechanical failure):
First Instance
You will be offered a reschedule in the same or equivalent vehicle.
Your damage waiver (if purchased) will carry over.
You will receive a free upgrade as a goodwill gesture (e.g. onboard video, photo package, or passenger ride).
Second Instance (on Rescheduled Date)
If the vehicle is again unavailable, and your drive cannot proceed, you will be entitled to a full refund for that portion of the experience.
If an alternative vehicle is offered on the original date and you choose to accept it, no refund or reschedule will be issued.
4. Voucher Refund Policy
Vouchers are fully refundable within 30 days of purchase, provided they have not been redeemed.
After 30 days, or once redeemed, vouchers become non-refundable.
Vouchers are valid for 365 days from the date of purchase.
You may request an extension of an unused voucher before its expiry (fees may apply).
Expired vouchers hold no value and cannot be redeemed, refunded, or reinstated.
5. Non-Refundable Items
Certain optional items associated with your booking are either non-refundable or refundable only under strict conditions:
Damage Waivers:
Non-refundable under all circumstances from the moment of purchase.
If your event is rescheduled due to vehicle unavailability (see Section 3), your waiver will transfer to the new date.
Optional Upgrades (photos, videos, passenger rides):
Refundable only:
Within 30 days of purchase, and
Only if the service has not yet been delivered
After 30 days, or once fulfilled (whichever comes first), the upgrade becomes non-refundable.
Refund requests for optional upgrades must be made before your event date. If your event has already occurred, no refund can be issued regardless of delivery status.
6. Additional Terms:
Governing Law:
This Refund Policy is governed by the laws of England and Wales, consistent with our Terms of Service. By accepting these terms, you submit to the exclusive jurisdiction of the courts of England and Wales.
Limitation of Liability:
Race Competitions Ltd’s total liability is limited to the remedies provided in this Policy. We are not liable for:
Travel or accommodation costs
Loss of income or time
Any consequential, indirect, or incidental damages
We strongly recommend arranging travel insurance or refundable travel/accommodation plans.
No Waiver:
Any exception we make to this Policy (e.g. goodwill gestures) does not waive our right to enforce the Policy strictly in future.
Severability:
If any part of this Policy is deemed unenforceable by law, the remainder shall remain valid and enforceable to the fullest extent permitted.
